Please read and accept the Terms of Use (“Terms”) carefully prior to
using the Enhanced Maritime Situational Awareness (“EMSA”) marine
domain awareness system. Should amendments be made to these Terms,
users will be required to review and accept the new Terms prior to
accessing EMSA.
Your access to and use of the data, information, and tools
(“Resources”) in EMSA is conditional on your acceptance and
compliance with these Terms.
By accepting the Terms below and using EMSA, you acknowledge having
read, understood, and accepted the following Terms:

Your User Account is for your use only. Access to EMSA, by
others, through your User Account is not authorized.

The Resources in EMSA are for informational purposes only. EMSA
provides access to a variety of datasets including open and
public sources. As such, the Government of Canada does not make
any representations or warranty with respect to the accuracy,
reliability, or timeliness of the information or resources
available through EMSA, nor does it assume any responsibility
whatsoever for the information provided. The data owner is
solely responsible for the process followed, criteria assessed,
and credibility of datasets prior to publishing. Therefore,
EMSA is not permitted to be used as a primary tool for the
purpose of:

Navigation, search and rescue or emergency response in, on,
through or immediately above water;

Replacing Government of Canada approved safety equipment and
tools, including Automatic Identification System (AIS), Very
High Frequency marine radios, or Global Positioning
Systems. All emergency communication must continue to be
directed to a Marine Communications and Traffic Services
Center or other applicable emergency services provider;

Compliance and enforcement activities up to and including
prosecution, issuing charges and fines, suspensions or
cancelations of licenses or certifications. Access to and
input into EMSA is not to be construed as a way of
discharging regulatory or legislative requirements under
legislation for which the Minister of Transport is
responsible.

You agree to respect Indigenous peoples’ rights to maintain,
control, and protect their traditional, cultural, and
environmental knowledge, and data. The Government of Canada does
not hold any ownership of, or access to any user’s data, or
information within EMSA.

The ownership and control of user, community, or an
organization’s resources in EMSA remains proprietary and may not
be shared or otherwise used for any other purposes without
permission from the owner. Furthermore, the data and/or metadata
should not be altered, changed, or misused in any way.

The Government of Canada and Indigenous partner communities and
organizations co-develop the EMSA system. Under no circumstances
will the Government of Canada or its employees, servants or
agents, or participating Indigenous communities and
organizations be liable to any person or business entity for any
reason including claims arising from contract or tort, or for
loss of revenue or profit, or for indirect, special, incidental
or consequential damages arising from the use of information
accessed through this system.

The user shall indemnify and hold harmless the Government of
Canada and its officers, directors, employees and agents from
and against all claims, demands, liabilities, losses, suits,
damages, costs and expenses of every kind and description,
including penalties and reasonable attorneys’ fees, arising from
any breach of any of these Terms, covenants, obligations,
representations or warranties under these Terms, by the user
(including its officers, directors, employees or agents) and/or
arising from any negligent act or omission by them.

This initiative acknowledges, respects and adheres to principles
of data sovereignty. In addition, the Government of Canada
acknowledges and continually makes every effort to comply with
its obligations under UNDRIP (United Nations Declaration on the
Rights of Indigenous Peoples), in particular to Article 31,
which recognizes Indigenous peoples’ rights to maintain,
control, and protect traditional, cultural, and environmental
knowledge. Therefore, the Government of Canada does not hold
any ownership of, or access to user’s data and information in
EMSA.

You accept any further terms outlined in disclaimers of
individual resources. Data specific disclaimers will be
available in the metadata if there are any.

Content may be shared provided that you have expressed
applicable permissions from the data owners, and that the
content used does not violate the rights of any third party.

Inactive or underutilized EMSA licenses are subject to recall at
the discretion of the Government of Canada.

You agree not to interfere or interrupt or in any way disrupt
the servers/networks connected to the EMSA system.
These Terms apply to all users of EMSA. Violation of any these terms
may result in the termination or suspension of your access to EMSA
immediately and without any prior notice. The Government of Canada
will not assume any liability for your breach of the Terms.
